Help, 5 day notice FUP

Irving Olmedo
Posted

I served a 5-day notice for nonpayment of rent. The tenant paid half of the rent the day before the notice period ended, but the remaining balance is still outstanding.

In this situation, is it better to serve a new 5-day notice for the remaining balance, or can I proceed directly with filing an eviction based on the original notice? From a practical and litigation standpoint, which approach is stronger in Cook County/Chicago?
