Evict AND take late rent

I asked the magistrate's clerk when filing initial paper to evict ...what to do if the late tenant comes up with the rent. She said that if he owes me money take the money.. I said "He's just such an awful tenant..pattern of lateness" She said "Just tell him you're continuing with the eviction proceeding.

I've always heard if they pay the rent and late fees and court fees that that voids the eviction. Have any of you had the experience of doing both?

My problem is his roommate asked to leave one month early and he agreed. I have rented the apartment one month and have people coming from out of state. He could pay the rent, not pay June's rent and try and stay through July 31st and I would be in a heap of trouble. If I refuse the rent now that's 45 days to evict vs. a standoff on leaving one month early.

Can't you just refuse the rent and get a judgement for all monies due after the fact?
