Evicting a tenant

Hi

I filed for a writ of possession to evict the tenant two days back and am waiting for the sheriff to call me to schedule the eviction. I received an email from the tenant few days back that he will not be in the country for some time ( around a month ) to go see his dying mother. He lied again in the email saying that he deposited the last months rent but somehow it is not credited from his bank. Once I checked with my lawyer and responded him that I will consider my options if he pays the rent, the deposit problem vanishes and I see this months rent in my account.

I send a "rent with reservation letter" to the tenant and he acts confused and does not understand why he received that letter. when he spoke to my attorney, he is advised to show proof that he is really going out of country and the lawyer is asking me to consider postponing his eviction for practicable reasons if it turns out that the guy is genuine.

I highly doubt that this guy is genuine as he has summons all over the country where ever he lived. I am looking for honest advise whether to kick him out RIGHT NOW without any delay ( hoping he wont cause any further damage to the property) or let him stay for a month or two ( lawyer is asking the guy to pay the next months rent in advance before he leaves the country). All this assuming he has valid proof to support his claims.

I personally want to see him OUT ASAP but dont want to run into more damages etc and want to take an objective decision and not get carried away emotionally. Pl advise.
