Leases do not need to be in writing. Legally a verbal lease is all that is required. If you have paid rent to your landlord in the past, or even if you have not, the courts will hold that since you are occupying a landlords property it is understood there is a lease in place. In most states a term lease automatically becomes a M2M upon it's end point with the same terms exist. Tenants can not escape the legalities of a landlord/tenant relationship.

The 100% clincher however is if you have in the past paid rent for the unit. If you did you had a lease agreement in some form and it remains valid until you vacate the property.

A expired licence is a separate issue and can be easily remedied by the landlord.
