What is the consequence to a landlord if renting to undocumented?
How do you inquire about this when screening? I don't want to discriminate, or even give the perception of doing so.
I don't know what to be more afraid of, breaking the law by asking the wrong question and consequently discriminating unintentionally, or breaking the law by renting to undocumented immigrants if it is illegal to do so. But, people have to live somewhere. Don't they ?
To be clear, I am happy to rent to qualified people no matter their national origin. I just don't want to find myself facing fines or worse.
It is not necessary for you to even ask their citizenship status. However, a "consequence" may end up being that they get deported and you now have a vacant property, without even knowing until the next months rent doesn't come in. The only illegal nature would be if you are knowingly harboring a fugitive (wanted by law enforcement, not just being in country illegally). Being an illegal alien is an administrative violation for them, not a criminal violation.
For legal immigrants you ask all the same questions because they will be employed with a taxpayer identification number instead of a social security number.
