Tenant owned MHP stops paying pad rent??

Question

I’m interested in Mobile home parks but was wondering for tenant owned parks...what happens if the tenant stops paying their pad fee? If they own the house you can’t kick them out?  Or is it different per state?

@Johnny K. every state will have unique regulations with respect to the relationship between the landlord and the tenants.  AND, they will also be unique to MHP as compared other asset classes.  Make sure to find the attorney in your state who clearly understands the landlord-tenant laws for mobile home parks.

With that said - IN GENERAL, mobile home park tenants must pay the space rent as agreed on the lease.  If they don't, there is a period of time where you can only charge late fees, and proper notices will be required so you can pursue further action.  The next period of time will allow you to evict the tenant, and again proper notices will be required. During the time where the tenant has past due rent or fees unpaid, they do not have the right to move their home out of the park. In most states, once a tenant is evicted, you will have the right to pursue title to the home.

Before you consider the above accurate in your state, find an experienced attorney who specializes in MHP leases.  You should be able to do a search for "mobile home park attorney" or network with MHP brokers or property management companies to find the best one.
