Landlord refuses to fix ac unit
Landlord didnt want to fix the ac unit because the previous tenants dog messed up the outer AC unit and the coils are open and in sight. We have been living with it for 4 years and noticed our electric bill has been higher than ever. He is now selling the house and the buyers have requested it to be fixed as it did not pass inspection. Could I refuse to pay rent due to this? I live in Hemet, Ca where it is desert like heat most of the year but especially summer. Want to deduct rent for this but need to recoup our total deposit. Any info would help.

In Missouri, in order to withhold from paying rent, you would need to prove that the property did not meet basic structural, health, or safety standards. Before you withhold from paying rent, make sure that you are complying with state legal requirements. First you must notify your landlord about the necessary repairs. If the lack of adequate HVAC is detrimental to your health, you may be able to withhold rent only if the landlord did not respond to your inquiry within 14 days. You would likely need to report this issue to a local health department as well. Check with the local city municipality about landlord-tenant laws. I hope this helps!
