Can new landlords do next day eviction?

The mobile home park my friends live in just got new owners or managers. They haven't paid rent in God only knows how long because they apparently had a verbal agreement with previous person not to pay rent until water and electric were properly working. The new people are fixing up the park and are evicting people, the entire mobile home park is month to month. They told them they wanted them out by tomorrow otherwise they were calling the police. Can they do this? Is it legal?

@Beverly Hardee  If they have a lease, then it carries over with the new owners.  If it is month to month, then the owners need to give whatever notice the contract states/local law requires.  If the tenants haven't paid rent, then the owners can serve them with an eviction notice.  The police usually don't interfere as it is a civil matter.

Some investors will just try to bully people....there is a required procedure, requiring notices, which depending on the state laws takes from a few weeks to a couple of months before the sheriff shows up to actually evict.  They need to talk to their local legal aid office, or someone similar.

No, they can't simply kick out tenants the next day, even on a month-to-month lease.  The new landlords are still required to follow real estate laws/regulations.  Regardless if they hadn't paid the previous landlord, there is still an eviction process they must follow.

I'd encourage your friend to do some research on their states eviction process.  Push back and threatened to report them to the real estate commission/board if they must.  Then they're better off moving out.

Is this a regular trailer park, or is it one of those vacation ones where people aren't using it as their main address? That could make a big difference.

However, even in that case, if they are essentially squatting there then it'll take a regular eviction to get them out.

I'm pretty sure they need due process. They typically need to provide notice and go through their magistrate to do an evection.

I seriously doubt they tell people to get out.

Your friends should call their local magistrate and ask about this.

If they can afford to leave now it’s pry in their best interest. Staying an extra week or even month in an RV Park to end up with an eviction and a judgement on their record doesn’t seem like a good trade. (they’ve already admitted they haven’t paid rent in a long time and don’t have any paperwork.)

I don't think there are any formal papers. I'm not sure what the laws are in California or where to find out. Does it start with a 3 day pay or quit, or do they do an eviction.
