Tenant demanding unverified deposit back - need advice

Scott McQuilkin
Posted

Tenant swearing he paid property manager 2 months deposit.

I only received 1 month deposit, tenant cannot provide receipt of second month.

I sold houses 1 year ago.

Threatening to take me to court, is there any way I'd actually have to hire a lawyer and go to court for this?   Should I just pay him and move on?   I haven't owned this house in over a year and 100% never received this money.  Possible property manager never sent me the funds, but doubtful.  Feel like he's either confused or making it up.

@Scott McQuilkin assuming you’ve explained to him that you only received the one month deposit, you should explain to them that you want to help but ask them to provide proof of payment so you can attempt to track it down with the PM. Let them know that without the proof, you can’t do anything. Sounds like an unlikely case; if they can’t produce proof of payment to help you get them their money back then doubtful they can provide it in court.
