Evicting Tenant that is Leaving

Brian Chu
Posted

I gave a current tenant a 60-day notice of non-renewal that let them know I'm not planning on renewing their lease at the end of August. Somewhat unsurprisingly, they've decided to stop paying rent for July. I'm curious if it's worth me filing a formal eviction due to non-payment of rent. I have a feeling they aren't going to pay, and it might not be worth taking them to court.

As others have said I would go ahead and file since there is no guarantee they will leave at the end of August.  I am assuming these have been problem tenants or you wouldn't have chosen to non renew so I wouldn't wast any time.  A pattern I see when people post about eviction horror stories is that they waited too long, don't make the same mistake.  Who knows just the posting that one is coming is enough to get some people to pay but I wouldn't just sit there and take it.  While cash for keys does have its place I see it as a detriment to the community as a whole.  By filing you are giving everyone else a fair warning, if we all did this it would be much harder for problem tenants to find housing due to us having a fair warning of problems that are likely to come.
