Quick question, does anyone know if Arizona a super lien state? To be more specific Can HOA Foreclose on a house in Maricopa County?
@Brandon Witt : they can foreclose for delinquent dues (not fees for leaving your garbage out, etc.) My understanding is that it’s 12 months or $1200 before they can initiate foreclosure proceedings.
Do you know where and how to find out what properties are foreclosing due to HOA? Thank you
@Brandon Witt An hoa can foreclose on a property for non payment of dues without regard as to whether they are in a Super Lien state. Also, being in a Super Lien does Not mean their foreclosure wipes out any exiting mtg. I think there are like 15-20 Super Lien states in regard to hoa’s, but in only a couple of states does their foreclosure wipe out a first mtg, and with certain restrictions.
One the biggest mistakes beginners at auctions make is buying an hoa foreclosure and not realizing the mtg stays with the property....then getting foreclosed on by the bank.
Yes they can and in my understanding they have to pay off the lein holders
