With an Agent License, can I access MLS without . . . BROKER?

Question

Hello Most Intelligent RE Investors,

How are you all doing? Did you guys had a wonderful weekend? I have this one question - If I currently get a Real estate Agent License, must I work with a RE Broker before I can access MLS?

@Lawrence Monyei  I am going to say 99% you need to hang a licnese with the broker and that only brokers can access MLS  agents cannot on their own.

back in 1977 I went to battle with the Santa Clara county CA Board of realtors  IE you had to be a member to get MLS access.. well there had been a recent ninth circuit ruling that upheld you did not.. and since I was a solo broker only working for myself.. I was able to join the MLS but NOT the board of RE.. in ORegon they force you to join the board of REaltors I just never fought it as 1k a year is nothing money so it would be more hassle than its worth.

Hey @Lawrence Monyei,

Yes you will need to hang your license with a broker in order to have access to MLS as an agent in GA. You can't do anything with your license without a broker. Essential only a broker has the right to perform real estate representations, and they grant you access as an agent to work on their behalf when you hang your license with them.

If you go take the test for your RE license and pass it, but don't have a broker yet, your license will immediately go into inactive status.

Brokers have to pay for access to MLS. Some will pass that cost onto the agents to pay, and some brokers will pay for it and allow you to have access for free. I guess it's not technically free because you will be giving them a hefty split from your production.

But at the same time, there are ways to access MLS without a license. And there are also ways to access MLS data outside of MLS through other services, though sorting through the data won't be exactly the same.

@Lawrence Monyei As a REALTOR in Nebraska, in order to have access to the MLS, you must hold the REALTOR designation with your local board of REALTORS. While every jurisdiction may be different, I believe that the MLS is specific to REALTORS or abide by the Code of Ethics, Equal Opportunity in Housing, etc. I do not believe that "basic" real estate agents are able to access the MLS.

Although my guess is that you will have to register at a broker office (at least in NJ).

What's stopping you from "hanging" your license (ie. registering at a broker office)?

Hi Larry,  I can only speak for Maryland and DC where I am licensed.  Sales people must hang their license with a broker.  Agents have to provide their brokerage information to register with the MLS.
