Has anyone evicted a tenant for Nuisance in Connecticut?

Hello All,

I have a tenant in Connecticut who is receiving support from DMHAS. They pay the rent for her, so I always receive it.

The problem I have run into is that she is disturbing the other tenants. She is yelling and screaming in the middle of the night. She has thrown clothes, knives and other things out of windows. I have spoken to her and her case manager a number of times about the issues. Her case manager says he has been looking for a place for her to live, it has been about 6 moves and they haven't moved her out. Recently, something happened and one of my tenants is saying she doesn't feel safe living in the apartment.

I called her case manager and he says they haven't been able to find a place. I said it has been a very long time. I'm not sure how hard they are actually looking.

Anyways, I would like to get her out. I have evicted tenants for non payment of rent, but never for being a nuisance.

Is the process any different?

Different strokes for different folks. I would establish the building one way or the other, either cater to folks with MH issues and make the entire building that way or not take on those tenants at all. I think your real issue is having a mixed-tenant building. If this tenant is truly dangerous, they belong in an institution. I highly doubt the caseworker is looking for a new place and rather, will wait until you evict to take on that task. I know that's what I would do if I was the caseworker.

I think having a nuthouse is a noble thing. I would likely work to send the "normal" tenants on their way and let the nuts have their space in this world. The only concern I would have would be those that might live in their own filth. Otherwise, whats the big deal with a few outbursts? I think it is more nuts to move into a multi-family building and somehow expect to never be disturbed by other tenants.

Crazy is relative. People thought Columbus was crazy too. Doctors used to think blood-letting was sound medical practice. And, in today's world, people believe politicians actually care about their constituents and what comes out of their mouths is truth. So, you tell me, what really defines crazy?

Non-monetary breach evictions are difficult. You sometimes need to send a Kappa notice which gives them an opportunity to cure the breach (i.e. nuisance here). You should have the Kappa notice served liked you would the NTQ and Writ as it needs to be an exhibit to your lawsuit. You also need to keep the subsidy provider (at least if it is HUD) on notice of the breach and correspondence.

You also need to understand that judges do not like non-monetary breach evictions. They want the parties to try to work it out before they will remove someone from their home for being a nuisance - naturally, disturbing the quiet enjoyment of the neighbors premises is the counter-argument to that. I would recommend using a lawyer for this type of eviction even if you currently handle your non-payment cases yourself.
