Seller won't sell to "builders"

I ran across 3 lots that are listed for sale on MLS, and called the agent to ask if they were still available. She said yes, and sent me the parcel map. On the phone she said that the owner did a 4 way split and built on one of the lots, and lives there. She said if I wanted to see them, he could show me the lot lines. I told her I'd talk to my husband and son, then call her back with time. She called back and said " never mind, you can't buy the lots because the seller won't sell to a builder, because he wants to control who moves in and lives in the area" I explained that was illegal, and she became irate. I explained she needed to take the lots of MLS if they aren't available for sale to the public.

A little while later I got an email saying all the lots had been sold. Seriously? In 10 minutes? I hate unscrupulous real estate agents! They give all of us a bad name.
