Eviction Process for Johnston County, NC

Hello Bigger Pocket Users,

This is my first rental property investment and unfortunately I have a tenant who needs to be evicted.

The tenant hasn't paid any security deposit nor first month rent (Dec 2019). Here is the brief story, The tenant gave 2 personal checks ( one for security deposit & one for first month rent) at the time of handing the keys. I know what you are thinking but yes that was the first and biggest mistake I learned ( taking personal checks).

The first month check was returned due to insufficient funds. I am still holding both checks. When reached out to tenant, she keeps pushing the timeline promised. Since I am into 18 days, I felt I need to follow the process of eviction. ( should have started on Dec 6th )

Contract Start : 11/29/2019

Lease Term: 2 years

City: Clayton

County: Johnston County.

So far I have sent 2 email notices to the tenant to pay the rent. I also alerted that if I do not receive the rent due by Dec 20th, I would follow the Eviction Process.

My lease document is a standard NC form.Do I still need to give 10-day Notice to quit. If in which form - email/certified mail/stick to front door etc

I read few forums, some mentioned the eviction notice has to go from sheriff's office and some mentioned I can file @ court house .What is the right way to begin for eviction in Johnston County NC

Can anyone please guide me thru the process.
