As a wholesaler can you get properties under contract that are listed by Real Estate Agents?

Technically you should be able to.

Unless the listing broker/agent is a complete moron they wouldn't let you unless you put up serious non-refundable earnest money held by the seller or their attorney if you didn't pull through. The agent can tell the seller what they think but ultimately the seller could go along with your plan against advice.

Many wholesalers do not have 10 cents to their name. They waste a sellers time locking up a property and then tell the seller " Oh well the end buyer didn't work out so see you later ! "

Having a wholesaler have large amounts of money on the line makes sure they vet the end buyer or have the ability to close themselves or they stand to lose a lot of money. If a wholesaler wants to put up nothing or the typical 100 type junk then the seller should insert a " right to continued marketing clause". If the wholesaler isn't going to put skin in the game for the seller then the seller shouldn't give an exclusive for their property to a wholesaler trying to assign and make a fee.
