End Buyer Not performing

It looks like there is a good chance my end buyer may not come through with financing for some reason.

In my assignment contract it says" Closing is to occur on or before August 7th."

However, a title guy I spoke with said that since It does not say "Time is of the Essence" that I need to send my end buyer a written notification of my intent to cancel the contract if she does not close?????

Can anyone provide some insight as to what my next steps and actions should be??
