RE license needed for "net listing" ?

Ive been listening to Bob Diamonds material and one technique caught my attention that is called a "net listing". I believe you have to be an agent for this, but im not sure so I thought Id ask here.

Basically, it goes like this - you find a "motivated seller" who is coming out of bankruptcy and just wants to get out of their house. You make an agreement with the seller that you guarantee them a fixed price, but that you will also advertise the property and you get to keep the difference if you sell it at a higher price.

The benefit is that you never take ownership, so that if you cant sell the property, its no loss to you.

My question I suppose is
- do you have to be a licensed agent to advertise a house for sale, if you do not own the property ?
- has anyone else done this ?
