The licensed/unlicensed question is probably one of the most frequent questions I see in regards to wholesaling. You do not need to be licensed to wholesale since you are supposed to be marketing just the contract not the property itself. However, this depends on how the wholesaler conducts their business and this is why it is an ongoing gray area. I suggest any potential wholesalers to be licensed since it opens more doors of opportunity and allows you the flexibility to directly review comps on the MLS, list properties, bid on certain properties etc. Wholesalers I have spoken to say their business has greatly increased once they were licensed since it removes any questions. People (and agents alike) dealing with you also know that you have passed an FBI/state/federal background check. It should also be mentioned that an unlicensed person who sells a property that they do not own is a 3rd degree felony in Florida.
