Looking for advice on a buried oil tank

Hi everyone, The other day I went to take a look at a foreclosed property and while looking around the outside of the house I found a stem for the oil tank sticking up in the driveway. The house was converted to gas heat and the tank was never removed. Does anyone know if that is something that has to be addressed if I were to purchase the house. The bank also said they know it's there and will not address it. my offer would reflect the cost of having to rip up the driveway and have the tank removed and possibly the cost of having contaminated soil removed. Has anyone had a similar situation before? The house is located in NJ.
