I am a big proponent for owning real estate in an entity. Especially where there's a partnership. The operating agrement is truthfully the most important element. Hire compentent legal counsel familiar with your local market to assist with the agreement preparation. It's best to be honest with your counsel and share each members strenghts and weaknesses as it will help your attorney provide the best legal services. Also, it's important to conduct thorough dilligence on anyone you intend on entering a partnership with. Even if uncomfortable, it's necessary to protect your interests and is fair to ask for copies of credit reports, conduct judgment searches and ask for references.
