Lease Renewal - points to include
Good morning,
My tenant has asked to renew her lease after completing her first year. I'm somewhat hesitant to renew, but finding qualified tenants in this area can take time, so I'm weighing my options.
If I do renew, I'd like to strengthen the lease to better protect my property while staying within legal and reasonable limits. I'd appreciate feedback on the following ideas, as well as any other recommendations.
- Payment deadline: Rent is due by the 1st and late after the 3rd. The tenant usually pays on time via Zelle or bank transfer, but on two occasions she initiated payment on the 3rd and the funds didn't reach my account until a few days later. I'd like the lease to specify that payment is considered received only when the funds are deposited into my account. Is this fine? Are there other better options for rent payment?
- Periodic inspections: I'd like to include a clause allowing a property inspection every four months (with any legally required notice) to ensure the home is being properly maintained and that occupancy complies with the lease. Is this generally permissible? In the past, I’ve had concerns that she has had people staying for extended periods beyond what my lease allows.
- Service calls and tenant-caused damage: I'd like the tenant to be responsible for the first $75–$100 of a service call if the issue is due to tenant misuse or negligence. The townhouse is brand new, but there have been numerous requests related to the A/C, garbage disposal breakage, bugs, and other maintenance items. My goal is to encourage greater care while remaining responsible for normal repairs and maintenance.
- Rent increase: The current rent is well below market, and I'm operating at a loss of more than $500 per month. Comparable units nearby are renting for significantly more. I'm only considering a $100 rent increase, but I'd like to know whether there are any lease provisions or renewal strategies that experienced landlords recommend in situations like this. I’m willing to absorb the short term loss because the property has good appreciation potential and is in a good area.
I'd also appreciate any general suggestions for lease clauses that have proven valuable, or links to any comprehensive lease checklist threads on this forum.
