May I ask that the building be vacant by closing?

The building has potential to cash flow IF the units are updated and rented at market rents.  May I include a request in my offer that the first floor unit be delivered to us vacant by close?

As a buyer you may ask for anything you please. It will be the sellers decision and responsibility to accommodate the buyer. It is the sellers problem not yours and they will decide if the can or are willing to comply with the request based on state landlord tenant codes and how motivated they are to sell. Put it in your offer and see what happens. Worst case you get a NO and move on to another property.
