Misrepresentation in property (what are my options)

Robert Vandivier
Posted

Hi,

I placed an offer on a property that was advertised as well maintained duplex. My agent wasn't able to show me the property.  The selling agent showed me the property with the tenants in the property.  The listing agent is friends with the seller and stated how all the properties the seller touches are well maintained and rock solid.  I walked the property and saw a crack near the window on the back of the house, but chalked it up as an 1940 brick house,  When I got the inspection report back the only thing that was up to code was that it did not have radon.  Is this legal in real estate to misrepresent properties?  During due diligence I asked for the sellers chart of account and the sellers agent stated he doesn't keep track those records.  I backed out of the contract but I feel like this is a scam collecting dd money.  Thanks for your time.

@Robert Vandivier

What are your damages ? Spent money looking into a property that you didn’t buy? Chalk that up to cost of doing business. Happens all the time.
