No rent - 45 days delinquent

My tenant has been in the property since March 2024 and has paid rent timely till last month. However, they've fallen behind since August. reason for delay is death in family and some unexpected expenses that came with it. They have paid 50% rent for August and nothing for September. Spoken to them a few times and every time i get the same "I will pay some amount shortly' response. I think ive given them enough time, and am losing patience now.

Looking for some tips as to how to approach next steps. Should I start by sending a 3 day notice (which is the first step for eviction in texas) ? I'd rather not take the legal route but need some commitment that they'll pay the outstanding amount shortly.
