My First Eviction! Help! I need some perspective.

I'll try to provide a quick summary. Tenant fell behind 2 months rent, so I started the eviction process in May. The property is in Hoffman Estates, IL. The tenant avoided being "served" by the sheriff, so we served by posting. (?) Now they haven't paid since March and they owe 5 months at $1975 plus late fees. The total, depending on if September rent is included, will be between $10k and $18k. Our court date is set for August 25th and now they are wanting to try to settle. A few questions...

1. My lawyer is telling me the judge will not award me late fees. Is this true? Why? 

2. Is it better to make an agreement out of court or go to court? What are the risks? 

3. What should I do to solidify my chances of actually receiving payment?

Chicago doesn't allow late fees but they do allow court costs so be sure to add that.  I wouldn't settle. Just put them on bad credit. You will hear from them at some point when they need a loan.
