Thanks for the information everyone! 

Here is an update. We agreed on a settlement. Judgement is $21,000 and some change and they agreed to leaving in 2 weeks. There was an order of possession ordered for that date. I went to the property on that date and they were still there. AAAHHHH! Rudely, the guy says he will be leaving the following Friday. So then I ordered an eviction with Cook County, IL. I found out that Cook County can take anywhere from 3 to 8 weeks to do an eviction. AAAAHHHH! 

Luckily, I heard from neighbors that the tenants had moved their stuff out on the Friday he said. I went back a week later and found the place empty. Changed the locks and now preparing to sell. 

Looking back, I probably should have went to court and pleaded my case. I believe that would have allowed me to take possession sooner and garnish wages to get some of my money back. Thanks again! Anybody looking to buy a townhouse near Hoffman Estates, IL ?

More of a townhouse than a condo, but it is listed as a condo with the HOA. Great space. Built in 2004.

3 Beds upstairs, 1 in basement. 3 and a half bath. New tile floor in dining room.

I'll try to provide a quick summary. Tenant fell behind 2 months rent, so I started the eviction process in May. The property is in Hoffman Estates, IL. The tenant avoided being "served" by the sheriff, so we served by posting. (?) Now they haven't paid since March and they owe 5 months at $1975 plus late fees. The total, depending on if September rent is included, will be between $10k and $18k. Our court date is set for August 25th and now they are wanting to try to settle. A few questions...

1. My lawyer is telling me the judge will not award me late fees. Is this true? Why? 

2. Is it better to make an agreement out of court or go to court? What are the risks? 

3. What should I do to solidify my chances of actually receiving payment?
