NC Eviction of Section 8 Tenant for Late / Partial Rent Payment

Wondering if there is anything special to be known when dealing with a potential North Carolina eviction of a Section 8 Tenant who has not paid their portion of the rent, but the Housing Authority has paid their part? For example, $900 rent and $450 has been paid by the Housing Authority (received late on the 6th); but the tenant still has not paid their $450 portion. 10-Day Notice to Pay or Vacate has been served as of today, so we plan to file for eviction on the 20th if still not paid, but wanted to make sure that getting partial payment from the Housing Authority does not alter the handling.

Also, how are late Housing Authority payments best handled?

Receiving the HUD portion is not an issue, but your notice to pay must be accurate with the tenant portion balance only. Evicting a Section 8 tenant comes with the huge positive that usually 1/2 to 3/4 of the total rent is paid until the day you receive possession of the unit back, at least that's how it works in Los Angeles.

Getting HUD to pay on time can be a whole other issue. Get in touch with them and find the tenant's advisor. Call or email them to see the status of missing payments. It takes time to get accurate after an initial move in or rent increase, but then things seem to smooth out.
