Allow tenant to install storage shed?

Question

The rental property has a huge back yard and the tenant has asked to install a storage shed.

I'm considering adding a Lease amendment with the following conditions.

Tenant is allowed to install a storage shed at the Tenants expense under the following conditions:
â€¢	Storage shed will be Tenants personal property.
â€¢	Tenant agrees to remove all parts of shed, including any foundation materials, within 30 days of the expiration/ termination of the lease.
â€¢	In the event that Tenant does not remove the shed within 30 days of lease expiration/termination, the shed shall become the property of the Landlord with NO compensation to the tenant for the sheds value.
â€¢	Landlordâ€™s insurance will NOT extend to the storage shed or shedâ€™s contents.
â€¢	Footprint of shed will not exceed 230sqft. (roughly 15ftx15ft)

Any other conditions I could add or risk I should consider?

Is it a new shed? Maybe put something in that gives you approval of the type of shed before he installs it. That way if they do leave the shed and it's a piece of junk, you won't have to pay to have it removed.

Permits?  That would require a permit in my area.

I would not allow 30 days after the lease ends for the tenant to remove it.  Remove it when they leave or its yours.  I'd phrase it in terms of when the tenant vacates, not the lease ending.

I would also want to approve the actual shed before it is installed... you don't want to remove some 10 year old shed that your tenant bought on craigslist for 50.00 if he decides to leave it when he vacates your property.

I don't know if if this clause is a good idea--what if someone falls and gets injured in that shed? You would want your liability insurance to cover you in that case.

This is not exactly the same situation, but I have a old wooden storage shed in the backyard of the first rental house that I bought. The former owner built it by hand. I decided to keep it and put something in the lease to the effect of: "tenant uses shed to store belongings at his own risk and is advised that shed is not guaranteed to be waterproof..." But I didn't specifically mention insurance.

I'd change the remove within 30 day of the lease expiration to to be removed by end of lease expiration. You don't want them to mess around the property when you show it to prospective tenants, or worse yet - after the new tenants move in. I'd also insert something that constitutes the shed your property if not removed by end of lease.

I would definitely want approval over the design and construction.  I would actually want to hire the contractor myself, that way you know it is built right.  Also, increase his security deposit.  There will be costs associated with hauling it away when he abandons it.

I would not specify that your insurance does not cover the shed, instead put in language that you are not liable for any damage to the shed and require the tenant to get insurance for the shed themselves.

That makes sense. I would just add something like "not responsible for damage to structure caused by acts of God, theft, vandalism, etc."
