Smoking Violation when Lease says no smoking, Washington State

Hi My lease states no smoking. the Tenant lives below me and is moving out next week but I smelled marijuana and was having to use my inhaler more and found out the reason. How much of security deposit can I keep?

Hi @Laura Keels , the only way you would be able to keep a portion of their security deposit is if there was damage to the property. If there is no damage, you should send them a lease violation and a fine if that is stated in the lease. However, if they are leaving next week anyhow, that might fall on deaf ears.

I believe it depends on the condition of the unit and whether remediation is necessary.
