Writing Lease as As Agent for Owner

Kathleen Gray
Posted

We have begun to now manage property for other owners.  However, we are looking for protective ways of creating Lease Agreements where identification is noted as to who the actual parties are within the contract, that being - us (property management) and the actual property owner.  Does anyone have any suggestions?

Replied

Have seen so many PMC's do this wrong and represent themselves as the landlord-owner.

As a PMC, you are only an AGENT for the owner. So do NOT represent yourself to tenants as the owner. Since the word "landlord" implies you are the "lord of the land", you probably don't want to represent yourself as that either.

Our lease identifies the owner (just their name or their LLC, etc.) and then identifies us as the owner's agent for the lease.

Of course, check with a knowledgeable real estate attorney in your state.
