HOA is requesting a copy of lease agreement. Weird?

Question

HOA is requesting a copy of the lease agreement, they suspect the property is short term leased. It is a long term lease with several tenants in a decent sized home.  By laws state no short term leases less than 6 months, this is a 15 month lease. Am I legally obligated to provide it to them? I don’t see anything in the by laws regarding occupants per home, that seems discriminatory.  This HOA seems completely over the top in general and get excited to find people quickly. How should I handle?   Thanks!

I would just give them a copy but black out any personal info. Best to not go to war with your HOA especially if your not doing anything wrong.

Read your HOA rules and know them inside and out.  Make sure your tenants have a copy of the HOA rules and sign stating they will follow them and any violations they cause will be a violation of the lease.

As far as giving them a copy of the lease.... mmmm not sure the legality of it but I’m not a lawyer.  I’d give them a blank lease that you use. I wouldn’t even give them a copy of the lease.

Also is this a condo or a home?  An HOA for a condo is very different than a HOA for a subdivision depending on the state and local laws.

I live in a HOA and while I wish I didn’t there isn’t anything they can legally do about me renting to a long term tenant.

I might even send a cease and desist letter stating their continued harassment without cause will not be tolerated.

@Thomas O., I think there is something bothering you about sharing this with the HOA and I don't think it is the term of the lease. you mention "several tenants in a decent size home". what is several here? are there any restrictions on how many occupants should be in your condo? if not, then you have nothing to worry about.

My HOA also requires a copy of the lease as well. While you can black out the rent amount (which doesn't even matter anyways), the HOA will have to know who the tenant is, especially if the tenant has to sign a form to state that they agree with all of the HOA bylaws an regulations, and what cars they drive, license plates, pool pass...etc. I don't think there is harm on sharing the actual agreement with them, as long as there is not anything in there that contradicts the HOA bylaws.

I agree with John.  Give them a copy with all of the details (name of tenant, amount of rent) blacked out.

Also make sure that all your tenants have been approved by the association. That will come up once you show them your lease.

If you are doing what you are supposed to be doing then I’d tell them to go pound salt .
