Don't let fireworks destroy your rental property

Every year, over 9,000 people are rushed to the hospital with serious injuries as a result of using fireworks. There are currently only four states that ban the use of fireworks in the United States: New York, Delaware, Massachusetts and New Jersey. Don’t forget that landlords can and will be held liable if any person is hurt or maimed on their property. Even if your state has not banned fireworks, you still have a say as to whether or not they can be set off on your rental property.

First, your lease agreement should include the right to quiet covenant, which goes for your tenants and their neighbors. If the tenants are creating noise problems with fireworks, you are within your rights to have it documented by police and warn them of lease violations with the threat of eviction.

Also, even in states where fireworks are legal, you get the final say in what can and can’t be done at your rental. Therefore, you need to include specific wording in the lease that bans the use of any fireworks on your property. Make sure the tenants understand violating this rule could get them evicted.

As an added precaution, you or your property manager can also email tenants the locations of public fireworks displays in the area to encourage them to go out and enjoy the holiday. This will not only keep the renters safe, but your rental property as well.
