Broker Not Paying Commission

Due to a mistake that I made on paperwork [minor paperwork]...my brokerage decided to let me go and now my license is with the state [NY] until I find another broker or start my own...

I had 2 deals going prior to leaving broker...1 deal has been closed since 4weeks and 1 closes this week...I asked for the commission check via Email with cc'd attorney. Broker has not responded..

? - Can he keep the check(s) and not pay me at all?

? - Can he stop me from becoming an agent with another broker/starting my own?

The broker cannot stop you from being hired by another brokerage.

as for the commission, that depends on your agreement with the broker or your state regulations. In my office, you would still earn a portion of the commission for the work done by you while you were still under the brokerage. it would not be a full commission because you did not see it through to completion, but it would be split based on the amount of work you did versus the amount of work the replacement agent did.

If you feel a commission was earned but the broker refuses to compensate you, I recommend you contact the state board and file a complaint. They will typically contact the broker first to see if they can negotiate a settlement before launching a full scale investigation.
