Oh NO my fire escape is encroaching HELP?

Hey all! Hope you are having a good weekend.

So I have a large expensive problem.  A fire escape. I have to build is encroaching on neighbors land.  Conty approved the structure so I had custom parts made that can't be returned $7,000 !!! What options do I have.  It needs to be where it is?

What Wayne said first. Alternatively, you could offer to pay for an easement for the stair case from the neighbor. I cannot see how you were given a permit to build without a current survey. I spend lots of time locating structures built over the line. Easily preventable.

Does your property start right where the deck ends?

It is hard to tell from the angle, but guessing the wooden stairs are not enough for fire code?  They don't look to be that much further away from where you are putting in the metal ones.

You can’t build on someone else’s property without their approval/consent. So you either need to rework your plan, or offer the neighbor money or other compensation to make it worth their while.

You can get mad at the city/town, but they aren’t going to be able to help with this issue. They likely gave you a permit based on the plans you submitted. If the plans show a code-compliant fire escape, you get the permit.

Sorry, there’s not much magic here. The company can probably rework some of the parts as needed if you can locate it differently... but it’s on you to figure that out.

He owns the whole easement and won’t agree to share it . The county approved new my plans but never went through zoning . Survey says I own up to my awall he has the hallway . But the code office gave me so much false info. Why would they approve if they didn’t ask zinging

Have you talked to the neighbor and see what they say? Perhaps they don't care and you can make everything right by spending a couple hundred for a lawyer to draw up paperwork between you and the neighbor.

That’s yours on the right?  Looks like you’ll need to move the edge of the “deck” in to line up with the edge of the wooden staircase?

They have you a permit with no survey?

Do you have a survey so you know Exacrly where the property line Really is?
