You have and pay a PM for a reason..... use them. They should handle all of this.

And why do they not like the PM? It may very well be because the PM is doing their job... enforcing rules, repairs, late fees etc etc. Its like when Mom says NO, the kids run to dad because he's a pushover

You need to document the return of the money every single time. The first time let the tenant know that rent is still due to the PM, but this one time you will remove the late fee if paid by X date since they accidentally paid to the wrong entity. Send it certified mail so that you can show that you didn't keep the rent.

The next month, return the rent and have the PM charge a late fee before accepting rent. This may cause you to have to remove the tenant, but if they won't accept the new PM, it sounds like you don't really want him. The worst thing you can do is let the tenant dictate how things will go.

1. The fact that the Property Manager isn't leading the way by dealing with this Tenant demonstrates their lack of competency. I would look for a new Property Manager.

2. The Owner should be firm by rejecting all communication from the Tenant. If Tenant tries to contact the Landlord, they should report that to the PM and let the PM handle it. If Tenant drops off payment, it should be returned to the Tenant and doesn't require a note reminding them of anything. Just send it back. If PM doesn't receive the rent per their instructions, they should treat the rent as unpaid and deal with the Tenant accordingly. In my lease I have a penalty for every time the Tenant attempts to contact the Owner directly.

3. The reason Tenant's don't abide by the Agreement is because nobody is forcing them to. Do you think my mortgage lender would allow me to deliver payment to their personal home instead of their designated office? If you want to be a professional, you need to act like a professional.

@Bob Stein get ahold of your lawyer and see if that meets the definition of breach. He is the one who is going to have to explain it. If so start working on getting the tenant out and fixing the issue with the owner.

If you didn't agree to the owner receiving payment market it as late.

Find out why the tenant has an issue with your PM. Take that information and let the PM know that they are ineffective at the job you hired them to do. You might need a new PM.

If the tenant doesn't deliver payment at the designated place, then technically its a breach of contract. However aside from telling them to follow the lease, your remedy is to evict. Do you want to evict a rent paying tenant?
