You can sell your home even if it's not paid off.

Home ownership comes with many benefits, including the right to sell your home should you decide to. In fact, you have the option to sell your home even if there's a mortgage on it. Your lender does have a right to protect its security interest in your home. However, your lender can't generally tell you when and to whom you can sell your home.

Due-on-Sale Clause

A mortgage lender's strongest security interest in your home comes from your mortgage loan's due-on-sale clause. Basically, due-on-sale requires that your mortgage loan be repaid in full upon sale or conveyance of your house. Using due-on-sale, your mortgage lender usually receives full repayment of the loan it gave you if you sell your house. Other than due-on-sale requirements, and outside of any unusual foreclosure-avoidance sales, your mortgage lender's involvement with your sale is fairly limited.

Lien Satisfaction

Your mortgage loan is the superior, or senior, lien on your home in almost all cases. Basically, if you sell your house, your mortgage lender will be first in line demanding that its loan be repaid in full. In typical real estate sales, the proceeds from the sale of your home are divided up among you and your lender, at minimum. Any other liens, such as taxes, on your home are also paid out of its sale proceeds.

Selling Your Home

Once you sell your home your will ask your lender for a mortgage loan payoff amount. Your mortgage lender might need to know certain particulars about your home buyer such as her own mortgage lender. However, federal law prohibits lenders from considering race, sex or other characteristics when it comes to buying and selling of real estate. As long as your home buyer is financially qualified, your lender won't do anything to prevent your home's sale.
