I do not know about California but in Georgia for instance if the tenant was not personally served at the door by the sheriff or they did not file an answer to the court then the judge cannot grant a judgement in your favor only dispossessory. To get damages you then have to go to small claims court and win.As far as things left behind each state has personal property disposal laws.In GA for instance if it looks like they have abandoned the property then you put notice and gain entry. If you do not have a key you can drill the lock.If in GA 500 or under of value in property is there you can just throw away.Anything that looks to be over 500 the attorney usually advises completing the eviction.Even if they have appeared to vacate but there are valuable items there you need to wait. You need to take pictures with time and date stamp to document what was there upon inspection to prove they didn't leave that 5,000 family heirloom later on!
