I realize that no one can/should provide legal advice on this forum, I just wanted to ask if anyone had experience being sued by a non-tenant. 

I would argue that cap rate, in most real world transactions, is one step short of meaningless.  

If it is a single member LLC (owned by one person or if the partners are you and your spouse and you're based in a community property state) the rentals would still be reported on your schedule E on your 1040.

So, if your goal is immediate cash flow in the short term, it may be better to sell that one.
