First, you probably need a better, more detailed lease, and second, you might want to err on the side of caution and simply release the security deposit in full, assuming the tenant otherwise has fulfilled their obligations of the lease.I hope that helps.

I asked to see this executed agreement between him and the bank, and he tells me that it is a 3 month trial, and that there is no written agreement from the bank until he fulfills the terms of the trial.

I would reply that the buyback would be backed by an executed contract for the purchase at the end of 12 months, including penalty clauses if not fulfilled

Additionally, including clauses that allow for the removal of a trustee if they fail to fulfill their duties can offer further protection.If you did not already work with an experienced attorney to draft this trust initially, or if it has been a while since it was created, I'd recommend sitting down with local counsel to ensure the trust conforms with your intentions.
