And then it goes one of two ways - either the borrower (or broker) slinks away with no further comment or they become indigent that it all your fault because you didn’t uncover their fraud “fast” enough; or you he previously produced a term sheet (based on the false information or non disclosure of pertinent facts by them), or you didn’t ask them specifically for the information they with held, or that shouldn’t be a criteria, or you’re discriminating against them, or a million other reasons meaning a affirmative action their “victim” status.

In theory, DSCR loans should be easy but the largest pitfall is how the guidelines vary lender to lender and thus there are a lot of bad actors that make false promises to get you in the door, or they don't fully relay what needs to be done in the background for your loan to be approved.

Reasons why you don't need an LLC:You likely have a mortgage which protects you.You should have insurance which protects you.Moving your property into an LLC could trigger your mortgage due on sale clause.LLC'S can give you a false sense of security because a good attorney will likely find a way to pierce the corporate veil.

I don't advertise those rates because most are seeking 70-75% LTV, so I don't want to do false marketing.For max LTV, my lowest rate guys are around 6.5%.

The losses will become real once the properties are sold and lost and the DST members no longer own any portion of any asset and haven't received their money back.Where it appears CREW may have acted criminally is in defrauding KHCA, and by extension inducing folks to invest in the DST under false, misleading or fraudulent representations.Additionally, if they have used cash flow from one DST to pay expenses at another property or pay CREW Enterprises' operating expenses and salaries in violation of the operating agreement, that would amounts to theft.

Because I've had some people give a false landlord telephone number, I even ask the landlord the address of the house, the rent amount, how long the tenant has been there etc.
