In that case you should get an attorney involved as encroachment would be a material issue that if known should have been disclosed both to the broker and to any potential buyer.  

You already register with the state when you form your LLC, with some states already disclosing who the owners in a partnership are. 

You have to disclose you are an agent and people statistically don't like or trust agents.
