You should be able to cancel the contract due to non-performance...if they balk, threaten to hire an attorney or at least call one, you can usually get a phone consult for about $300 hr...Do not pay any significant money until work starts and even then, only pay as the work proceeds, i.e. when the framing is donem, pay for only that, when the tile is done, pay for that.

Most mom and pop subs simply do not go through the steps.. but for us building new homes the bigger sub or material suppliers all use a service to file the pre lien notice which for us is a certified letter I get about 10 of them a month.As well as if they fail to file the lien at all subs and material suppliers can then go to court and file a suit for Unjust enrichment and go that  route.

The house needed some work but nothing too crazy, and we also did some upgrades to make it more desirable to a potential tenant/buyer down the road including adding central air and converting the half bath to a full bath with a nice tiled stand-up shower to make a full master suite and a 3 bed 2 bath home.

We replaced all floors with wood-look tile, built a new deck, installed a new water heater, upgraded the bathroom and kitchen, updated light fixtures, and applied fresh paint inside and out.
