If I foreclosed and upon inspection, was reasonably able to state that it did not appear to be inhabited, I would be able to defend my action in court if it ever came to that.

As long as the property is 500K or less and you move into it without 92 days and inhabit the residence for at least one year.Which definitely saves some money and makes cash flowing more possible.

I am speaking based on a specific personal experience that was similar in nature.In my case my tenant did contact code enforcement and code enforcement did call me and tell me that they had to tell her that technically the place was not inhabitable with only plug in heaters as heat.
