Governor Desantis' Executive Order banning evictions for non payment of rent was extended through at least July 1st (and the CARES Act extends if even further if you have Fannie/Freddie financing in place or accept any type of Federal assistance such as Section 8).Even an eviction attorney's hand would be tied right now, and the courts are a gamble. 

@Casey Crotty I believe the last extension of the governor’s eviction moratorium specifically allowed evictions for cases where the tenant is committing waste (harming the dwelling, no pun).

At the very least I would (1) wait until the Governors order is lifted and then (2) serve your tenant with 45 day written notice (which is required NRS118A.300) of any rent increase.  

Hopefully your state Governor hasn't encouraged tenants to use their deposit to pay rent.

I posted a reference to the law that was current as of this March 28, but the governor signed HB 404 on April 22.

There are a number of groups who have filed law suits against the governors for going outside there authority.  

I just liquidated CA in the last year expecting the market turn and also not liking how our out of touch governor was making it almost impossible to get bad tenants out.

I mean, our former governor Schwarzenegger is speaking out about this, plenty of local politicians, etc.

The governor does not sign those deeds every day.
