They would trigger the gain inside the entity and still wouldn’t qualify for 121, because the property still wouldn’t have been owned and used by them as individuals for the required periods prior to “their” sale.Some options are to sell it inside the S-corp/1065 and pay the tax, or if the property has been legitimately used as a rental/investment property, the entity could potentially do a 1031 exchange.
