Like you've stated, while there are no tenant/landlord laws regarding second hand smoke in Florida- landlords are required to provide safe and adequate living conditions for their tenants by way of implied warranty of habitability.

The former I have no problem with, the later I am very much in favor of requiring that any animal given this designation at minimum go to a dog trainer.. but that is not the law.

@John Slater well.. there is an assigned trustee and the 90 day window has passed... would the fact that an assigned trustee exist imply that it would go into probate anyway?

Either way, be prepared for this to happen again by making those contacts first... you'll be able to sleep better moving forward.That said, your story definitely implies to me that the tenant isn't too worried about paying rent.

Luckily for me, it's only 7 days, after which no disapproval is implied approval, and technically they approve the lease and not the tenants.
