You should hire a third party person that is approved by the seller like your title company or an attorney or any individual you both can trust

This used to work always; now some courts have found it only works if the borrower did not provide a personal guarantee. this alone would be a good reason to only file deeds trusts and mortgages with the county, and not notes.

The LLC will give you the loan personally.The "promissory note" tells the title company how to draft the "deed of trust".
