Wholesaling is not illegal in any state but in every state, there are ways to wholesale illegally.Brokering without a license is any one of the following: negotiating a price with seller for the benefit of another, marketing a property you do not own, receiving financial gain for bringing a buyer and seller together.To do it legally, you either need to get a real estate license or have your buyer lined up in advance, use a new entity or trust to vest your offers in with the buyer being an owner of the entity (or beneficiary of the trust).

The Son could setup a land trust with the dad with him being the trustee and parents and him being beneficiaries equally in such a way that each has 50% beneficial interest in the property .
