Illegal garden unit

Recently purchased a multi-family duplex down (foreclosed property) that has a basement unit that sets up perfectly for a one bedroom one bath rental unit.  There is common stairway access to the unit, and considering adding an egress window to make it compliant.  However, the city inspected the property (prior to close) and specifically called out the basement as not approved for rental.  Should I put the brakes on trying to set this space up as an additional unit?  Need to make some quick decisions on rehab costs and don't want to spend any money down there if it has no chance.  Thanks
